Q1.    If the tenants don’t pay rent, what can I do?

A1: We can serve the tenants with an N4 form for the rent that’s owing.

Q2.     If the tenants are damaging the property, what can I do?

A2: We can serve the tenants with an N5 form for the damages. Requesting them to either fix it or pay you for the damages they’ve done to the property.

Q3.     What can I do if I need the house back from the tenants for myself?

A3: First of all, if there’s a lease you can’t do anything until the lease ends. After that we can serve the tenants with an N12 form on your behalf to get back the property for you.

Q4.     Am I allowed to increase the rent?

A4: Yes but only after 12 months have passed since the tenant moved in. We can serve the tenants with an N1 form and we can only increase the amount which is allowed by the guideline of the Board.

Q5. What happens to the tenants when the lease expires?

A5: The tenant becomes a month to month tenant.

Q6. What can I do, if I don’t want the tenant to continue as a month to month after their lease expires?

A6: We can serve the tenants an N8 form letting them know that the tenancy will end at the end of their term (lease).

Q7. What happens if I have tenants and I sell my house?

A7: First of all, if there’s a lease you can’t do anything until the lease ends. After that we can serve the tenants with an N12 form on your behalf to terminate their tenancy for the purchaser to get the vacate property.

Q8.  What happens if my tenants and I want to end the tenancy on a certain date?

A8: We can serve the tenants an N11 form where both the landlord and tenants have agreed to end the tenancy on an exact date. Both the landlord and the tenant must sign the N11 for it to be an agreement.

Q9. Can I evict my tenant because I don’t want them renting my property anymore?

A9: No. You can only evict the tenants under the reasons set out by the Landlord and Tenant Board. Examples, non-payment of rent, damages to the property, you or one of your immediate family members would like the property to live in or you have sold the property and the new owner wants the property vacate.

Q10. What happens if the tenant does not want to leave the property after you have served them with the forms and the termination date has passed?

A10: We will file either an L1 or an L2 Application on your behalf depending on which form was served on the tenant. The Board will give us a Hearing date and the board member will hear the matter. The member will give an Order to terminate the tenancy and evict the tenant as long as everything was done according to the rules and procedures of the Board. Our office only follows the rules and procedures set out by the Board to evict or terminate a tenancy between a landlord and tenant.
